Proposed use of outside communal amenity space to create private gardens and wheelchair accessible parking for new dwellings
Housing Act 1985 Section 105 consultations
Under Section 105 of the Housing Act 1985, we have a legal obligation to consult tenants of our buildings on matters of housing management where the changes are likely to substantially affect secure tenants.
Housing management covers changes to the management, maintenance, improvement or demolition of homes let by the Council under secure tenancies, or changes to the provision of services or amenities in connection with such homes.
Lindley Road, Godstone
We are proposing converting the former sheltered housing kitchen and lounge into a one-bedroom wheelchair accessible rented property. This is to increase our supply of accessible dwellings for households on our housing register. We have submitted a planning application for the conversion works which will be considered by Planning Committee at a future date.
As part of the proposal we would like to create a private garden for the occupant by using some of the existing amenity space. This consultation relates to the reduction in outside communal amenity space that will be available for existing tenants.

What happens next?
All representations will be considered by officers before a final report is provided to the Council’s chief executive for approval.
