Gaming machines

An operating licence for a gaming machine is not needed if:

Arcades

  • You make available for use a category D machine in accordance with a family entertainment centre permit issued by the licensing authority. Part 10 Section 247(1).
  • You make available for use a machine which does not offer the player an opportunity to win a prize. Part 10 Section 248 (1).
  • You make available for use a machine that does not offer the player the opportunity to win a prize of a value that exceeds the amount that they pay to play the machine. Section 249 (1).
  • You make available for use a machine that is designed for the playing of bingo by prize gaming in reliance on a family entertainment centre or prize gaming permit issued by your local licensing authority and you comply with any relevant provision of a Commission code of practice as to the machine specification and/or the circumstances of its use. Section 235 (2) (g).

Alcohol Licensees (other than those holding club gaming or club machine permits)

  • You hold an on-premises alcohol licence from your licensing authority. This automatically permits you to have 2 gaming machines each of which is of category C or D provided that you give the licensing authority notice of your intention to do so and you comply with the provisions of the Commission's code of practice about the location and operation of machines.
  • You have a licensed premises gaming machine permit (issued by your local licensing authority) which permits category C or D machines on the premises and you comply with the provisions of the Commission's code of practice about the location and operation of machines. The permit will specify the number of machines that can be made available. Section 283 (1)-(5).

Clubs

  • You hold a club gaming or club machine permit from your local licensing authority. These permits allow you to have 3 gaming machines each of which must be category B, C or D. provided you comply with the provisions of the Commission's code of practice about the location and operation of the machines. Section 271(1)-(7) & 273 (1)-(5).

Fairs

  • You provide category D machines for use at a travelling fair and any gambling (including machine gambling) is no more than an ancillary amusement at the fair Section 287(a) (b).

* Category D machines with a 10p stake are entitled to offer prizes of up to £5 in cash, or up to £5 in cash and £3 in non-monetary prizes. Category D machines with a 30p stake can offer £8 in non-monetary prizes only.
